Upon request, you may also be required to paint a 2' x 4' swatch along with trim/accent color on the front of your house for the committee to view.

If extending or remodeling your driveway, only one (1) material is permitted. There must be landscaping/plant beds bordering the front of the house. No concrete or pavers are allowed to come directly to the house with the exception of a walkway. The driveway may not go beyond the width of the home and may not extend to be in front of the front door. Circular driveways are permitted. Three (3) car wide driveways will not be permitted. Drainage may not be affected when installing new driveway material in the swale. Permitting is required and the responsibility of the homeowner.

Only One Material Type is Permitted: If using pavers, a minimum of 2 3/8 thickness paver is recommended.

If fence is in an easement and in the event that the fence needs to be removed, at any time for any reason but any utility, governmental agency or the Southwind Lakes Homeowners Association, Inc., the fence removal and replacement will be at the expense of the homeowner.

Landscaping Removal

Please note that Palm Beach County Code requires a certain number of hardwood and palm trees be on each property. It is the homeowner’s responsibility to ensure their lot is meeting county code requirements for landscaping.

Generators Visible from the Street Must Be Screened

The homeowner is responsible for complying with all Palm Beach County building codes and zoning requirements. After the ARB approval is granted, the homeowner must obtain the necessary permits. Once approved by PBC, the permit must be forwarded to management.

Homeowners Affidavit

I have read, understand, and agree to abide by the Covenants and Restrictions of the Association. I understand and in return for approval, I agree to be responsible for the following:

• To comply with all state and local building codes,
• To comply with HOA conditions of acceptance (if any),
• To complete the project according to the approved plans. If the modification is not complete as approved, said approval can be revoked and modification shall be removed by the owner at owner’s expense.

I also understand that the HOA does not review and assumes no responsibility for the structural adequacy, capacity or safety features of the proposed construction, alteration, or addition; for mechanical, electrical, or other technical design requirements for the proposed construction, alteration or addition; or for the performance, workmanship or quality of work of any contractor.

I agree to abide by the decision of the ARB and/or the Board of Directors. If the modification(s) is not approved or does not comply, I may be subject to court action by the Association. In such event, I shall be responsible for all reasonable attorney’s fees.
